Apparently, there are some jurisdictions in the country that are as crazy as California when it comes to protecting illegal aliens from federal immigration law enforcement. A newly released Declined Detainer Outcome Report from DHS documents a one-week list of counties in which sheriff departments have refused to comply with ICE in deporting illegal immigrants who have been charged with, and convicted of crimes.
The “Enforcement and Removal Operations – Weekly Detainer Outcome Report for Recorded Declined Detainers Jan. 28 – Feb. 3″ shows the highest volume of Detainers Issued to Non-co-operative Jurisdictions including Alabama, California, Colorado, Florida, Iowa, Louisiana, Maryland, Minnesota, New York, North Carolina, Oregon, Pennsylvania, Texas, Virginia, and Washington.
Travis County Texas, (greater Austin), is as bad as San Francisco when it comes to non-enforcement. A simple key word search of the detainer report lists Texas 149 times and all but seven of the counties listed are Travis County. And, as of January, 2017, The Travis County Sheriff’s Department is only willing to accept ICE requests for an immigration hold if it is “accompanied by a court order” and, in addition, only if the subject alien is “charged with or has been convicted of Capital Murder, First Degree Murder, Aggravated Sexual Assault, or Continuous Smuggling of Persons.”
But, illegal aliens charged with the following will not have their cases forwarded to federal immigration enforcement, including:
Vehicular homicide because of drunk driving.
During this one week period, the types of crimes, and number of times they were reported and did not result in an ICE hold is shocking. It’s more than shocking. Even for old hands at the issue it is jaw dropping.
- Forgery – 3 times
- Child fondling (child sexual assault) – 5 times
- Indecent exposure – 6 times (twice to minors)
- Traffic offense – 6 times
- Burglary – 14 times
- Drug possession – 15 times
- Domestic assault – 28 times
- DUI of alcohol or drugs – 40 times
- Assault – 57 times (including aggravated assault, use of a weapon, sexual assault including rape and assaulting a police officer with a weapon)
The jurisdictions’ criteria for honoring an ICE detainer are also included in the report. Some state quite clearly that regardless of any charge against the illegal alien perpetrator, they “Will not honor ICE detainer” as New York City declared in March of 2013.
Also, refusing to honor any ICE detainers are: Newark, New Jersey; several counties in Washington and Oregon; all county jails in Colorado refuse to honor ICE detainers, as well as the City of Aurora; and Clark County, Nevada (Las Vegas).
In Travis County, Texas, nothing but murder, rape and smuggling seems important enough for Sheriff Sally Hernandez’s cooperation with the feds.
Texas Governor Gregg Abbott cut off Texas criminal justice grant money to Travis County on February 1 as a result of their sanctuary policy.
Hopefully, cutting off all federal money to these jurisdictions will be next.
